3. Definitions
In these terms and conditions of sale, the following words mean :
WPMobile.App: the https://wpmobile.app/ website and e-mails,
Internet user(s): all visitors to WPMobile.App,
Customer(s): any individual or legal entity holding an account on WPMobile.App,
App(s): any app(s) added to the Customer’s WPMobile.App account.
4. Object
The purpose of these general terms and conditions of sale is to set and define the conditions and describe the procedure for :
the Internet user to register as a Customer,
define the conditions, price and purchasing procedure,
define compensation in the event of late payment,
define the conditions and calculation of the withdrawal period,
define refund conditions,
define the warranty,
define the means of access to after-sales service,
define responsibilities and availability,
define the conditions for processing personal data,
provide information on dispute resolution,
define the rules in the event of partial nullity of the contract,
define the conditions of modification,
define contract duration and termination conditions,
define the applicable law and jurisdiction.
5. Registration
Any natural person or legal entity may become a WPMobile.App Customer provided :
To be of legal age and to have the legal capacity to order the service,
To provide accurate information for registration, account modification and payment,
To have a valid e-mail address.
6. Price of service
Customers order their App online by entering the required information, and must install the WordPress WPMobile.App extension on their site to link the blog to the App.
The price of the Android version is 79€ HT
The price of the iOS version is 79€ HT
The price of the Android + iOS version is 149€ HT
Payment does not include access to the application’s source code.
Downloading and installing the extension is free and non-binding.
The following payment methods are available:
Credit cards (Axepta from BNP Paribas) or Paypal
Prices are always shown in euros and exclusive of tax.
It is agreed that WPMobile.App reserves the right to modify its rates with 30 days notice and without retroactivity.
7. Update
Application and plugin updates are free of charge.
8. Publication on Play Store and Apple Store
After payment you will automatically receive :
For Android: a link to a secure area to download the APK file (application file), images and screenshots.
For iOS: a link to a secure area where you can send us your App Store Connect credentials to receive the files needed to publish the application on your account.
You are responsible for all Google and Apple fees associated with opening a developer account.
9. Late payment
In the event of late payment, in accordance with article L 441-6 of the French Commercial Code :
An indemnity calculated on the basis of three times the current legal interest rate,
A fixed indemnity of €40 for collection costs.
10. Right of withdrawal
Since Apps are clearly personalized, the right of withdrawal does not apply to the service.
The customer explicitly accepts this reservation when placing an order by ticking a box.
11. Refund
Any refund will be at the discretion of WPMobile.App.
12. Warranty
No warranty of any kind is offered.
13. After-sales service
The Customer may contact the after-sales service for any questions or information concerning the use of the WPMobile.App service by e-mail (see article 2) for a period of 6 months from the date of purchase (12 months with the Assistance pack).
14. Liability
It is agreed that WPmobile.App cannot be held responsible in the event of :
Application not accepted by Apple and/or Google
Drop in traffic,
Drop in sales,
Cost of applying advice,
Or any other damage to the Customer or a third party resulting directly or indirectly from the service.
The Customer undertakes to use the WPMobile.App service at his own risk and under his sole responsibility.
The installation of the WordPress plugin is the sole responsibility of the user, and WPMobile.App cannot intervene in any way.
Costs related to the acquisition of hardware, the provision of the Internet connection, any services required to install the plugin or any other costs arising directly or indirectly from the use of the WPMobile.App service are the sole responsibility of the Customer.
The Customer is solely responsible for the confidentiality of the password used to access his account, and is liable for all use of the password, whether or not authorized by the Customer.
WPMobile.App is subject only to an obligation of means and uses its best efforts to achieve this, but is under no circumstances subject to an obligation of result.
WPMobile.App makes every effort to maintain access to its services 24 hours a day, but is under no obligation to do so and may temporarily interrupt access for technical or maintenance reasons.
15. Processing of personal data
The personal data that may be collected are :
E-mail address,
Company name,
SIREN number,
VAT number.
Full address,
Telephone number
Transaction number,
Purchase details.
The personal information collected is processed for the purpose of :
Customer management operations (orders, invoices, contracts, accounting, account management).
Managing requests for access, rectification and opposition rights,
To compile sales statistics.
The recipients of the data are :
The site editor and data controller as defined in article 2,
Any person holding the e-mail address and password for connection to the account,
The following may also receive data, within the limits of their respective responsibilities:
Public bodies, exclusively to meet legal obligations,
Judicial and legal officers as part of their debt collection duties,
Organizations responsible for debt collection.
Data is kept for the entire duration of the commercial relationship, and may be archived in accordance with the provisions in force if the data is required to establish proof of a contract or must be kept in order to comply with a legal obligation.
In accordance with the French Data Protection Act of January 6, 1978, amended in 2004, Internet users and customers have the right to access and rectify information concerning them, which they can exercise by logging into their customer account or by sending a simple request by e-mail.
WPMobile.App attaches particular importance to the management of personal data and implements all appropriate measures to restrict the risks of loss, deterioration or misuse thereof.

16. Dispute
In the event of a dispute arising from the use of WPMobile.App, the Customer may contact the publisher (see Article 2) to formulate a complaint, in order to initiate a mediation phase and attempt to find an amicable solution.
17. Partial nullity
Should any article of these general terms and conditions of sale prove to be invalid or unenforceable by virtue of a law or following a court decision, this article will be deemed unwritten and the rest of the general terms and conditions of sale will remain in effect.
18. Modifications
The parties agree that WPMobile.App may modify the service and/or these general terms and conditions of sale, particularly in the light of technical developments, by giving 30 days’ notice and informing the customer.
19. Contract duration
The present general terms and conditions of sale come into force on acceptance by the Internet user and/or the customer, for an indefinite period.
WPMobile.App may terminate it:
With a legitimate reason,
By giving 15 days’ notice,
By refunding the remaining balance.
The Customer may terminate :
Without cause,
Without notice,
Without refund.
20. Applicable law and jurisdiction
By using WPMobile.App, the Internet user or Customer unreservedly agrees to abide by French law.
These general terms and conditions of sale are in the French language.
In the event of any dispute whatsoever, the French courts shall have exclusive jurisdiction.
